Common Questions

Can the beneficiary of a petition file Form I-290B?

Generally no: only an applicant or petitioner may file an appeal or motion. The exception is the beneficiary of a Form I-140 whose approved petition USCIS revoked and who was advised that they may file a motion or appeal; that beneficiary includes the USCIS revocation notice with the I-290B.

Is Form I-290B used to appeal a denied I-130?

No. Appeals of Form I-130, and of Form I-360 petitions filed by widow(er)s, fall under the appellate jurisdiction of the Board of Immigration Appeals (BIA), and Form I-290B is not used for appeals to the BIA. Those are filed on Form EOIR-29, Notice of Appeal to the Board of Immigration Appeals.

What must the appeal statement in Part 3 of Form I-290B say?

It must specifically identify an erroneous conclusion of law or statement of fact in the decision you are appealing, and it goes with the form even if you intend to submit a brief later. The appeal must address every ground of ineligibility in the decision: a ground you do not address may be deemed waived, and that alone can be the basis for dismissing the appeal.
