Common Questions

Is there a deadline for sending in the TR-205?

Yes. The completed request and the required bail must reach the clerk by the due date shown in item A. If the clerk receives the form after that date, you are not eligible for trial by written declaration.

What evidence can I include with a TR-205, and do I have to explain it?

Item 5 lists photographs (with the total number), a medical record, registration or insurance documents, an inspection certificate, a diagram, a car repair receipt, or other evidence, and it should include everything you want the court to consider. The Declaration of Facts must explain each checked item and how it supports your case.

What happens after the court gets my TR-205, and what if I disagree with the decision?

The clerk notifies the officer who issued the citation, who may submit a declaration by a set due date, and the court's decision is mailed to you. If you are dissatisfied, you can ask for a new trial by filing Form TR-220 within 20 days after the decision was mailed.
